Current smoking restrictions under the Freedom to Breathe Act that apply to cigarette and other tobacco products also would apply to e-cigarettes, according to HF 2404, an omnibus health and human services bill approved by the Senate Thursday, May 8. Before taking a final vote on the bill, the Senate rejected an amendment sponsored by Senator Paul Gazelka, R-Nisswa, that would have only limited use of e-cigarette in state buildings. According to Gazelka, the Federal Drug Administration has not ruled on the use of e-cigarettes, and the product should not be banned in private buildings. Bill sponsor Sen. Kathy Sheran, DFL-Mankato, argued people in all buildings, public and private, should be protected from the e-cigarette vapor because the risk of inhaling the vapor is unknown.
